Some people here are under the notion that music should be free. While I'm the first to admit that I've downloaded my fair share of MP3s, I'm not about to make this into a "political" issue---"Free Music for the 'masses". All we did was to take advantage of a situation---while it lasted.
Nothing in this life is free----NOTHING. And if you're getting a free ride; someone, somewhere---is paying for it. We have a right to enjoy music; and the artists, singers, musicians, composers, etc. have a right to make a living out of it. FREE is a very "nice notion", but easier said than done. Most people wouldn't provide society with inventions, entertainment, product, and or services if they knew they couldn't capitalize on it. For example, in Cuba medicine is free to all. There's just one problem---they don't have any to give it away. In a society where all is free, there is no incentive to work (why should I work if I don't have pay for anything). A society that doesn't work, doesn't produce. Such a society is doomed. Those ridiculous society that gave away things for "free" ended up bankrupt, poor and some even in famine: the former USSR, China (trying to change things),
Eastern Europe, and ofcourse the starving North Koreans.
Yes, FREE sounds good to the ear, but in practice we pay a very high price for the "FREE THINGS" in life. I believe that most of us here are beyond those years when we used to be "idealist" and dreamers---maybe it's time to come down to the real world.
If you can't steal it, buy it.

Whoa! That reply said it all. Then again, to add to the notion of free, why are for promotional copy LP's and 12" singles still being distributed in another method?

Yes, I agree with Fantomas, some posters in this board are under the apparent delusion that they are “entitle” to free products at somebody else’s expense, sorry, but just because a temporary technological window of opportunity allowed you to obtain ‘free’ music doesn’t mean that ‘legal’ owners of the product should look the other way and not try to stop you.

I just want to point out a couple facts, art, in all it’s present forms is forever coupled to commercial forces, in today’s world one cannot survive without the other, an architect can design the best looking building in the world, but if the ‘developer’ doesn’t lease any office space the architect is out of work!, regardless of how many reasons you may find to justified continued ‘free’ music downloads, (or software, games, films) , the fact remains that the Record Companies legally (unless the laws are changed!) own their product and are entitle to take any ‘legal’ measures to protect it, they are the ones who decide how their product is distributed in the market place, and they set the price as high as the market will bear, we either buy it or not , that’s how the system works, sometimes I don’t like it either, but frankly I wouldn’t have it any other way.

All Night clubs , Radio Stations, Restaurants, and any other establishment around the world that profits from any prerecorded music(including playing MTV!) are subject to copyrights fees, many business use a more economical alternative, they contract services like MUZAK and others that offer different music packages to meet their needs (elevator music, music on hold) in return this companies pay a pre- negotiated fee for using the music to BMI and ASCAP (Publishing companies in charge of worldwide collection among other things), when calculating this fees BMI and ASCAP (they scan newsprints for violators) employ different formulas using variables like hours of operation, attendance, live shows, etc, and they in turn distribute (through artist’s unions) ‘royalties’ to the artists, (whether this royalties are adequate and fair is another story), of course, because of countless reasons in many parts of the world this rules are unenforceable, none the less violators are still legally liable to the publishers.(most countries signed treaties)

Promo copies sold on Ebay are ‘technically’ the property of the record labels, Ebay warns about this, but again, it is the Record Labels prerogative to enforce their rights, personally I believe Ebay’s vinyl trade is a small niche market not worth the hassle and expense to go after. Besides this ‘Promos’ cost was upset long ago by the promotion value they offered the Labels (and artist) during their initial release, never the less I’m sure they could shut down promo trade if they chose to.

Free downloads has done more harm to all consumers that many here can understand, as a direct consequence of this “Napster” mentality the US congress passed the ‘Digital Millennium Act’ when no one was looking, besides ‘enhanced’ online enforcement provisions (like we can see here on Disco.com), this law is already protecting new and complex ‘consumer intrusive’ copy guard protection codes that will unnecessarily limit our choices as consumers, this law, if not modify by the US Supreme Court (who knows if or when ) will force consumers into a future of “Pay per Use” material only with all kind of ‘techno restrictions’(already here) built into your electronic gear. (If you care to read about it do a search for DVI/HDCP), free loaders are responsible for this!

Regardless of any perceived unfairness regarding some aspects of these restrictions they are necessary to protect intellectual property for all citizens, they also protect our economic system and local tax base which in turn provide jobs that put food on your table, besides, just like you decide who drives your car they decide what to do with ‘their’ property. It’s that simple!

    Hello to everybody:

I almost agree with the arguments here.

But one thing came into my mind I am looking for a particular disco song that was never released in CD format (I'm a man by Macho). So how do I do to get it in CD format?

Ah...BTW I would pay for the copyrighted material...

    Cheers,

Hello Ressel, there are alot of computer programs (I won't mention names or trademarks on Bernie's site) that allow you to take an 'Analog' (turntables, cassette tape, reel to reel tape) recording, download it to your computer, convert the 'analog' signal into a 'digital' signal and 'burn' it to a cd. Since you own the 'Macho's' 'I'm a Man' lp your copying would be on the same level as someone using thier VCR to videotape a program for a later viewing. Check you local 'chain' or 'private' computer shop and ask for a program to 'create' cd's. They will gladly show you the right program for your needs. All the best, DJ Phil

    Hello DJ Phil:

Ah.... You are right. How could I forget this option...

But there is still a problem... I do not have this song neither in vinil nor in cassete tape or any form...I listened to this song here, in this site, through "Top 500" and loved it since I first heard it and I want it in CD format.

Ah...BTW I would pay for the copyrighted material... as soon as the copyright owner makes it available.

Also, it is vey difficult to find this kind of music in Brazil (I mean both Lp or CD, if ever existed).

    Cheers and peace,

Hello Fantomas, yes 'free will' is one thing but 'free music' will cost us all! Just think if it wasn't for all the 'free-loaders/downloaders' maybe Bernie would still have 'Dance Groove Radio' and 'DJ mixes' on his site:(. But because of all the MP3 music sites, the recording industry has to protect is property. All the best, DJ Phil

OIh yeah so now it is our fault that The Record COmpanies won't allow Bernie to have His Disco Raido!?!?!?!

Why don't you wake up from your coma of ignorance!!!

And See that it was the Recording Companies that forced him to close it and not the people sharing music

But DJ Phil, what about those who can't afford to buy albums that often? And isn't it a good idea to hear what a band sounds like before buying their albums? Many times downloading sound files was the only way to hear certain bands, especially obscure ones. Now I'm not calling you ignorant or saying that you're wrong. It's just that I feel that mp3s can actually help the record industry because if people can hear what the artists sound like (especially the ones who don't receive radio airplay, like more obscure ones), they would more likely to buy the albums from those artists. At least that's how I feel. Yeah, I know that I've said this several times before, and I don't mean to come off as repetitive.

P.S. Do you include mp3s that are available on record company websites?

sutnop sounds like a vengful creature (from reading thier posts), wants everything handed to them on a 'freebee' platter. I wonder if they paid for the computer they are using or if they expect that to be also given free also. I wonder if sutnop is a 'working person' or some child living off of Mommie and Daddie's income. If so, once they are in the 'real world' (and not that silly MTV farce) reality is going to hit them like a brick wall.

Hello my friends! I was reading these messages and I belive I can predict, with a fairly good degree of certainty, who is toing to be the next member to be banned from these forums. I don't believe it's going to be Blaxman, nor Nano, nor DJPhil, nor Jazz_Pilgrim, nor DiscJockey2973. I don't think it is even going to be me!

I think it's going to be a very outspoken member whose half-witted comments are only surpassed by his poor judgement and obtuseness.

(Yes, my friends, I can be very cynical when I choose to and when the ocasions merits it. I believe this is one of those ocassions.)

sutnop, I assume since you didn't contest my last post that you do recieve everything on a 'free-be' platter. Let me know the next thing that you 'invent' and post online so I can 'download' YOUR property for FREE. This way you won't receive any profits for you labor. Hopefully you will do this soon, as I will send the link of your new invention to every 'artist', 'copywright holder', 'record-label and employee' so they might enojoy the benfits of your LABOR for FREE. Hopefully you will spend as much money (as the above mentioned artist, companies and employees) on creating your product as they (studio time, recording fees, concert fees, insurance, buildings, telephone/internet access, (make-up, photograpy, costuems, cover art, production, pro-department, and artist developement) have. Then we will really see how you like someone taking YOUR PRODUCT and not paying for it!!!!!!!!!!!!!!!!!!!!

Please don't say it's me. I don't think I posted anything that would get me banned from this message board. I could be wrong, though.

Hi Outsider, reading the posts and you stated 'If you can't afford to buy LP's'. Excuse me, you have no problem affording a computer. Learn to BUDGET money (so much for bills, so much for car payment, so much for fun, etc.) so you will have money to BUY the music.

My apologies to Bernie and all forum mates for my previous quote. It's now edited and my opinion was at the heat of the moment.

Budgeting is easier said than done. It's easy for people with high-paying jobs (or who aren't supporting themselves) to say that because they have no money problems. Yes, I did manage to buy two albums recently (the new ones from Korn, which I bought for $11.88, and Skinlab, which cost me $9.99). But I rarely find bargains like that. But I can't afford to buy shitloads of albums like some other people. It's not that big a deal.

Forget paying bills? You must not be supporting yourself. As for car payments, well I own a couple of old clunkers. You see, I can't afford a new one, and I can't afford payments. **** it if my cars are from 1980 and 1975.

One more thing: My computer was a college graduation present. I could have never afforded one on my own. And it's an old model by computer standards (from 1994). I need a new one, but........I can't afford one. I can't afford DSL or cable either.

Look, I not trying to start a fight over this, and I've already said too much about myself, but this is one of those times where I need to explain myself. But this is all I have to say about this, and so I'm cutting this off now.
